Shalev Brants

Biography

Shalev Brants is a partner in the Environmental and Regulation department at our Tel Aviv office.

Shalev is active in all areas of administrative, criminal and civil law, representing and advising on regulation, environmental protection, water law and natural resources.

Shalev has extensive experience in all aspects relating to the intersection of business and regulatory requirements, including economic regulation of natural resources. Shalev advises legislators and regulators, handles administrative petitions against state authorities, offers ongoing advice to industrial plants in compliance with regulatory requirements as well as representation in civil and criminal proceedings concerning environmental protection, resource utilization and water use.

Bringing to bear Shalev’s multi-disciplinary experience in all the legal interfaces of industrial enterprises and the business sector with the various regulators, his clients benefit from a broad point of view and the ability to delve into individual professional issues in order to deal with any relevant legal arena while formulating a unified strategy that takes into account all consequences and options at hand.

Shalev has extensive experience in representing his clients in all phases of criminal proceedings, from investigation to prosecution. At the same time, Shalev has many years of experience in conducting administrative and civil proceedings against state authorities and third parties in issues relating to regulation and the use of public resources, including proceedings relating to imposing and reducing financial sanctions, cancellation and suspension of stop work orders and closure orders, class actions, petitions to change the conditions of a license or regulatory permit, and proceedings before Israel’s water tribunal.

Alongside the litigation work, Shalev represents his clients in public and legal forums, including Knesset committees and public hearings in the formulation of regulation.

Shalev regularly provides ongoing advice to representative bodies in his practice areas, including the Manufacturers Association of Israel and the Israel Institute of Energy and the Environment opposite various government authorities. His work with these bodies includes daily consultation on the issues at hand, assisting in legislative processes, conducting administrative petitions on behalf of the industry, and policy formulation.

Before joining the public sector, Shalev served in the Chief Military Prosecutor’s Office as an intern and then as an attorney.

In 2009 Shalev served as a public defender in the ranks of the Military Defense. He first served as a defense attorney at the Jaffa Military Court and the Military Court of Appeals, and then as a defense attorney and legal assistant in the office of the chief military defense attorney.

Prior to that, in 2006 Shalev served as a legal advisor in the civil and economic section of the Office of the Legal Advisor for the Judea and Samaria region. As part of his position, he dealt with commercial and economic law, international economic law and legal advice to government officials in the area of environmental protection, communications, infrastructure, tenders and contracts.

During his service as a legal advisor, Shalev gained vast experience in the way the government deals with issues by legislation, various administrative and statutory proceedings, as well as responding to petitions submitted to the Supreme Court sitting as the High Court of Justice.

 

 

  • Represented Dead Sea Works with respect to liability for water fees in the Dead Sea concession area, totaling ILS 100 million;
  • Represented a leading chemical company in a criminal case, in which the company was acquitted of water pollution and sea discharge offenses attributed to it;
  • Advised the cosmetics sector in the Manufacturers Association of Israel in the cosmetics reform process, in Knesset committees, the enactment of the Arrangements Law and negotiations with regulators;
  • Represented the Manufacturers Association of Israel in a petition to the High Court of Justice regarding water rates for factory effluents and recognition of easements for factories granted by the Ministry of Environmental Protection;
  • Provided assistance in canceling a notice of intent to issue an order to correct a distortion by virtue of the Water Law, against a customer accused of causing damage to a sewage treatment facility and a treated water storage facility;
  • Acted on filing a petition on behalf of the Manufacturers Association of Israel against the Ministry of Finance’s policy not to pay quarantine fees to symptomless Covid carriers;
